2. He shall have a female attendant present during all physical examinations of female patients.

3. He shall successfully complete a pre-approved professional boundaries course within six months.

4. Upon successful completion of the professional boundaries course he shall write and submit for review and approval by the Committee, a paper discussing boundary violations, including the effect of boundary violations on patients with a history of sexual abuse.

5. He shall obtain a pre-approved supervising physician who shall submit quarterly reports to the Board.

6. He shall meet quarterly with a designated Board member.

7. He shall pay a $1,000 civil penalty.

8. This Order shall remain in effect for a minimum of one year.

Nature of Misconduct: Violating a la law related to the practice of medicine; inability to practice medicine with reasonable skill and safety due to illness; becoming addicted or habituated to a drug or intoxicant.

Action Taken: Dr. Rowe's license is conditioned and restricted as follows:

1. He is reprimanded.

2. He shall contact and enroll in the Health Professionals Services Program (HPSP), St. Paul, MN, within ten days. He shall participate in HPSP and fully comply with all terms and conditions of his HPSP Participation Agreement and Monitoring Plan. Failure to comply with the HPSP monitoring plan shall constitute violation of this Order.

3. Under the terms of his HPSP Monitoring Plan, he shall submit to unannounced biological fluid screens on a periodic basis and such screens shall also be tested for the presence of fentanyl.

4. He shall meet quarterly with a designated Board member.

5. He may petition for reinstatement of an unconditional license upon successful completion of his HPSP monitoring plan and upon a minimum of five years of documented, uninterrupted recovery.

a. Chemical dependency awareness;

b. Medical records management;

c. Professional boundaries; and

d. Pain management (which has already been completed).

3. Following completion of the coursework, he shall submit for Committee approval, a paper regarding what he has learned and how he has implemented this knowledge into his practice.

4. Six months following completion of the coursework, he shall undergo a chart audit.

5. He shall not prescribe controlled substances for the purpose of addiction maintenance.

6. He shall maintain patient records that reflect the patient complaint, examination, diagnosis, treatment plan, response to therapy, and medications prescribed.

7. He shall develop and submit for Committee approval a written protocol for the management and tracking of controlled substance prescriptions.

8. He shall meet monthly with a pre-approved supervising who shall submit quarterly reports to the Board.

9. He shall meet quarterly with a designated Board member.

10. He shall pay a $10,000 civil penalty.

11. This Order shall remain in effect for a minimum of two years.
