Nature of Misconduct: Unprofessional and unethical conduct; Inability to practice with reasonable skill and safety due to illness; failure to maintain adequate medical records.
Action Taken: Dr. Beyer's license is suspended. The suspension is stayed contingent upon his compliance with the following conditions:
1. He shall participate in the Health Professionals Services Program (HPSP) and comply with all terms and conditions of his HPSP Participation Agreement. Failure to comply with his Monitoring Agreement shall constitute a violation of this Order.
2. He shall obtain a pre-approved primary care treating physician who shall submit quarterly reports to the Board.
3. He shall obtain a pre-approved treating psychiatrist who shall provide quarterly reports to the Board.
4. He shall engage in individual therapy as recommended by his treating psychiatrist.
5. He shall successfully complete, within one year, the following pre-approved coursework:
a. Chemical dependency awareness;
b. Medical records management;
c. Professional boundaries.
6. He shall be subject to random chart audits of his practice.
7. He shall maintain a daily log of all controlled substance prescriptions. The log shall be available for monthly review by his supervising physician and for quarterly review by his designated Board member.
8. He shall practice in a pre-approved group setting.
9. He shall obtain a pre-approved, on-site, supervising physician who shall submit quarterly reports to the Board.
10. He shall meet quarterly with a designated Board member.
11. He shall pay a $5,000 civil penalty.
12. He may petition for reinstatement of an unconditional license after three years of documented, uninterrupted compliance, stable mental health, and completion of the terms of this Order. Within 90 days of petitioning, he must complete a neuropsychological evaluation.
