O'Connell & Aronowitz Wins $43 Million Personal Injury Verdict on Behalf of a Client

ALBANY, NY (10/09/2009)(readMedia)-- In a 25 year old case, a New York State Supreme Court jury in Saratoga, New York awarded an astounding $43 million verdict to J. Tracy Busone, Individually and as Parent and Natural Guardian of Tiffany Busone, who was an infant at the start of this case. The jury found that Tiffany's injuries were sustained at birth by Bellevue's failure to follow proper hospital protocol. The Busone family was represented by Stephen R. Coffey and Robert Harris who was of counsel.

On October 8, 2009, an 6-person jury consisting of 3 men and 3 women, unanimously returned a verdict in the State of New York Supreme Court; County of Saratoga, in favor of Tiffany Busone. The verdict awarded Ms. Busone a total of $43,500,000 which included $20,000,000 for home health aides, $15,000,000 for future pain and suffering, $6,000,000 for past pain and suffering, and the balance for medical expenses and loss of earnings.

The jury found that Bellevue Maternity Hospital failed to follow proper hospital protocol while resuscitating and intubating the Plaintiff, shortly after her birth. Deprived of oxygen, for an extended period of time; Tiffany has Cerebral palsy and a limited ability to communicate. She is also confined to a wheelchair. Tiffany has and will always require a full time home health aide, medical equipment and she will never be able to work to help support herself.

In August Pamela Nichols and Stephen R. Coffey were successful in obtaining a malpractice award of $11 million on behalf of a client.
