Nature of Misconduct: Violating a state or federal law; unethical conduct; unprofessional conduct; inability to practice medicine with reasonable skill due to illness; improper management of medical records; abusive or fraudulent billing practices; failure to make a report to the Board.
Action Taken: Dr. Mutnick's license is suspended. The suspension is stayed contingent upon his compliance with the following conditions:
1. He is reprimanded.
2. He shall not prescribe, administer, or dispense any prescription drug or drug sample for his own use or his family members' use.
3. He shall read the "Model Policy on the Use of Opioid Analgesics in the Treatment of Chronic Pain," adopted by the Executive Committee of the State Medical Boards of the United States, Inc., and "Responsible Opioid Prescribing, A Clinician's Guide, Second Edition," by Scott M. Fishman, M.D.
4. He shall successfully complete, within six months, a pre-approved medical ethics course.
5. Following successful completion of the ethics course, he shall write and submit for approval, a paper discussing what he has learned and how he has implemented the knowledge into his practice.
6. He shall engage in therapy with a pre-approved psychiatrist or therapist, who shall submit quarterly reports to the Board.
7. He shall practice in a pre-approved setting.
8. He shall meet at least monthly with a pre-approved supervising physician who shall submit quarterly reports to the Board.
9. Within six months of the date of this Order, he shall submit to an audit of his practice.
10. He shall meet quarterly with a designated Board member.
11. He shall pay a civil penalty of $16,223.50.
12. This Order shall remain in effect for a minimum of two years.

2. During the suspension, he shall not practice as a physician assistant in Minnesota.
3. He shall sign releases allowing the Board access to all medical, mental health, evaluation, therapy, chemical dependency, or other records.
4. He may petition for reinstatement of his license upon submission of satisfactory evidence that he is fit and competent to resume practice with reasonable skill and safety to patients.

Action Taken: Dr. Stroemer's Order, dated November 8, 2014, is amended to include the following conditions:
1. He is prohibited from ordering, prescribing, dispensing, and/or administering Schedule II through V controlled substances.
2. He may petition to resume ordering, prescribing, dispensing, and/or administering Schedule II through V controlled substances no sooner than 12 months from the date of this order.
3. Six months after he is authorized to resume ordering, prescribing, dispensing and/or administering controlled substances, he shall undergo an audit of his prescribing practices.
4. Upon being authorized to resume ordering, prescribing, dispensing and/or administering controlled substances shall maintain a daily log of all controlled substance prescriptions.
5. He shall meet monthly with a pre-approved, on-site supervising physician who shall submit quarterly reports to the Board. Upon being authorized to resume ordering, prescribing, dispensing and/or administering controlled substances, the quarterly reports shall include a review of a random sampling of Dr. Stroemer's patient charts and prescription log.
