Proposed Legislation Looks To Mediation For Child Custody Reform

ALBANY, NY (05/07/2007) (readMedia)-- The New York State Dispute Resolution Association (NYSDRA), a nonprofit professional membership organization for dispute resolution providers and supporters, will take the lead in commemorating Alternative Dispute Resolution (ADR) Day on Tuesday, May 8, 2007. Professionals from across New York State, in the field of ADR, will gather in the capital for a day of legislative meetings and an awards luncheon. Governor Spitzer has proclaimed May 6-12 as Alternative Dispute Resolution Week.

The ADR community will come to the capital with a collaborative message to pass two companion bills (Child Custody Reform Act) that would amend the Domestic Relations Law by adding a section that would require judges to screen parties going through child custody and support disputes and allow them to refer suitable participants to a mediation information session. Parties would them have the option of pursuing mediation or returning to litigation. The companion bills are sponsored by Senator William Larkin and Assemblyman Mark Weprin.

Child-centered mediation is a proven method of returning the focus to where it belongs–the best interests of children. The Child Custody Reform Act would assure that parents involved in child custody and support litigation are informed of their option to voluntarily participate in the mediation process, where such participation would be safe.

“In child custody and support litigation, the natural love of parents is often overshadowed by fear and insecurity generated through adversarial proceedings,” said Brett P. Linn, NYSDRA Board President. “Children unfairly suffer severe emotional, financial and educational harm when placed in the middle of adult conflict which is beyond their understanding and not of their own making.”

Following the morning (8:30AM – NOON) legislative meeting, the Crowe Plaza will host a luncheon (12:30-2:30) honoring the recipient of the prestigious Andrew Thomas PeaceBuilder Award. This year’s award is being bestowed upon Louise Diamond, Ph.D. for her exemplary efforts to instill peace in places of deep-rooted social conflict around the world.
