Action Taken: Dr. Nelson's license is reinstated and then suspended with the suspension stayed contingent upon his compliance with the following:

1. Participation in the Health Professionals Services Program (HPSP) and fully comply with all terms and conditions of his HPSP Participation Agreement and Monitoring Plan;

2. Shall not prescribe controlled substances;

3. Shall not have access to controlled substances in the work or educational setting;

4. Shall not prescribe or administer any prescription drug or drug sample for his own use, for family members' use or for any person who is not in an established physician/patient relationship with him;

5. Shall sign releases allowing the Board to obtain medical, mental health, or chemical dependency records from any treating professional, evaluator, or facility;

6. Shall practice in a pre-approved, group setting;

7. Shall obtain a pre-approved work-site monitor;

8. Shall limit his practice to no more than 30 hours per week and shall not take call;

9. Shall provide a copy of this Stipulation and Order to his employer in any approved practice setting;

10. No sooner than six months from resuming practice as a physician, he may petition to modify the terms of this Order. The Committee, at its discretion and by its own Order, may modify the prohibition on his ability to prescribe controlled substances, reduce the terms under which he may have access to controlled substances and/or increase his allowable work hours; and

11. May petition for reinstatement of an unconditional license no sooner than four years from the date of this Order and upon submission of evidence, satisfactory to the Board, of a minimum of four years of documented, uninterrupted recovery.
