Regarding Today's Comptroller's Report

ALBANY, NY (01/28/2010)(readMedia)-- The Office of the State Comptroller (OSC) has raised concerns regarding a painting contract that the New York State Department of Transportation (NYSDOT) recommended for award. We want to reassure both OSC and the public that NYSDOT's contract review system, one that has been endorsed by OSC for many years, safeguards expenditures of public money.

NYSDOT performed its due diligence duties in this, and, as we do in all contract reviews, provided OSC with complete information when the recommendation to select the company in question was submitted. Further, all additional information requested by OSC was provided.

Under New York State law, contracts must be awarded to the lowest responsible bidder. After analyzing all the relevant documentation and information, NYSDOT found the company in question to be both a responsible and low bidder and, therefore, recommended award.

Nevertheless, in the interest of further stewarding the public good, NYSDOT will implement the Comptroller's recommendation and will review this contractor's responsibility through the hearing process.
