NYS Labor Dept. Issues Nearly $22,500 in Violations Against Beaux Visages Salon

Order to Comply Issued on Behalf of Nine Workers of Closed Latham Salon

ALBANY, NY (04/08/2008; 1229)(readMedia)-- State Labor Commissioner M. Patricia Smith announced today that the department has cited Alan R. Jones and CARJ Holding Company, Ltd., owners of Beaux Visages salon located at 579 Troy-Schenectady Road, Latham, New York, for unpaid wages of $11,126 due to nine employees. The wages are due for work performed from February 4 to February 29, 2008. In addition, the department has assessed interest of $175.58 and a civil penalty of $11,126.38.

The Department of Labor launched a prompt investigation on March 20, 2008 after learning that Beaux Visages closed its business without paying employees their wages. The Order to Comply was issued on April 4, 2008. Payment of the wages due, interest and civil penalty are due within 60 days unless an appeal is filed by the employer with the Industrial Board of Appeals.

“In these tough economic times, it is reprehensible for an employer to close down a business and withhold money from hardworking people who have bills to pay,” Commissioner Smith said. “We will use every means at our disposal to collect wages that are due. Any worker who is owed back wages should not hesitate to contact us.” The investigation of Beaux Visages was conducted by Senior Labor Standards Investigator Elizabeth Ares. When the Division of Labor Standards receives a complaint, it will conduct an investigation to determine if the employees are receiving the proper compensation. The division has investigators, some of them bilingual, throughout the state to monitor compliance. If they determine that employees are not being paid correctly, they assess fines against the employer and order payment of back wages and supplements. The State Labor Department’s investigators will answer any questions employers or workers may have regarding compliance with New York’s labor laws.
