Cited for violating New York’s workers’ compensation law
ALBANY, NY (10/03/2007; 0844)(readMedia)-- Workers’ Compensation Board Chair Donna Ferrara today ordered a Queens construction company to shut down for not complying with the state’s workers’ compensation laws.
Board officials on Monday, Oct. 1, served a Stop-Work Order on RSC Operating Corp. of 32-47 Queens Blvd., Long Island City.
In March, 2006, an RSC worker injured his right ring finger, resulting in a finger tip amputation. A workers’ compensation law judge subsequently ruled that at the time of the injury, the business had no insurance to cover the injured worker. The Board has assessed RSC $28,511 in penalties and restitution.
Workers’ compensation law mandates businesses to carry workers’ compensation insurance if they have employees. Reform legislation signed by Gov. Spitzer in March grants the Board Chair the authority to shut down businesses for failing to comply with workers’ compensation law. The Board also can assess a business $1,000 for every 10 days it is out of compliance with workers’ compensation law.
RSC can apply to the Board for reinstatement once it agrees to restitution and secures a workers’ compensation insurance policy.
