Common Cause/NY Urges Judge Ho To Schedule Evidentiary Hearing In Adams Case

NEW YORK, NY (03/10/2025) (readMedia)-- Today, Common Cause New York submitted a letter to Judge Dale Ho urging him not to dismiss the corruption case against Eric Adams without holding an evidentiary hearing. The letter is attached.

Last week, Judge Ho appointed former U.S. Solicitor General Paul Clement to independently argue whether the Court should dismiss the charges against Adams in accordance with existing precedent. Following Clement's recommendation that the case against Adams should be dismissed, the federal government submitted sealed exhibits to the court that underscore the need for more transparency.

"The DOJ's effort to submit sealed evidence criticizing prosecutors in Mr. Adams' case only undermines the legitimacy of a potential dismissal. While the Court may be limited in its ability not to dismiss the case, it must ensure that the process is transparent and not clouded by accusations of prosecutorial misconduct. In absence of a trial, New Yorkers deserve to have all of the relevant information about Mr. Adams, who is actively running for re-election. We urge Judge Ho to schedule an evidentiary hearing and make all relevant documents public before dismissing the case," said Susan Lerner, Executive Director of Common Cause New York.

In the letter, Nick Ackerman, Common Cause Board Member and former Assistant Special Watergate Prosecutor, writes:

"Based on the record already established, and as Amicus Paul Clement's advice supports, deny the government's motion to dismiss without prejudice as made in bad faith to exercise improper leverage over Mayor Adams to ignore his obligations to his constituents in order to cooperate in the Trump administration's migrant policies, and hold a hearing."
