NEW YORK, NY (05/06/2011)(readMedia)-- An Oneida County man who claimed headaches, neck pain and back problems prevented him from working was sentenced on Monday to pay $42,600 in restitution for workers' compensation benefits he never should have received.
Dennis J. Clark Sr., 52, of the Town of Paris, was also sentenced to five years probation after pleading guilty to insurance fraud in Herkimer County Court. He admitted that he lied when he submitted work activity reports falsely stating he was not working because of job-related injuries.
Clark began to receive workers' compensation benefits in 2001 after he was hurt while working as a sanitation engineer for a local garbage collection company. But he later worked for another garbage collection company while continuing to receive the benefits between 2005 and 2009.
Clark was arrested following an investigation by the New York State Insurance Department's Frauds Bureau. The case was prosecuted by Assistant District Attorney Jeffrey Carpenter.
